TERMS AND CONDITIONS OF SALE
JLC DIVING CORPORATION (known as " French Kiss Divers Malapascua")
By booking training or diving with JLC Diving Corporation, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before booking.
1. Schedule and program changes
JLC Diving Corporation reserves the right to modify, without prior notice, the schedules and/or programs of training courses and dives, notably for reasons of safety, weather conditions, unavailability of boat/crew or any other unforeseen circumstance. The safety of our customers and our team is our top priority. In the event of changes, reasonable alternatives will be proposed whenever possible.
2. Down payments / security deposits
Any deposit paid to reserve a training course, a dive or any other service offered by JLC Diving Corporation is non-refundable.
In the event of cancellation on your part, the amount may be carried over once to another reservation withinone (1) year of the initial reservation date, subject to availability and the conditions in force at the time of the new reservation.

Private transport: refund possible if cancellation is received at least 48 hours in advance.

Deposits and/or hotel reservations: may be postponed if we are notified at least two (2) weeks before the scheduled arrival date.

Full refund of deposit and transport (excluding hotel): possible if cancellation occurs more than three (3) months before the scheduled arrival date.
3. Training deposits (SSI)
Training deposits are required to guarantee your place. They are non-refundable, as they represent an activation fee paid directly to SSI - Scuba Schools International for your registration, whatever the reason for cancellation.
4. Payments, cancellations and no-show policy
The balance of any booking must be paid in accordance with the terms and conditions communicated at the time of booking.
In the event of cancellation on your part, deposits are not refunded but may be carried forward in accordance with article 2.
No-show / delay :

Convocation time can be 30 to 45 minutes before boat departure for briefing and preparation.

Any delay preventing boarding may result in the loss of the dive concerned , without refund or postponement.

All no-shows are due in full.
We invite customers to inform us of any changes as soon as possible.
5. Medical requirements and fitness to dive

The SSI medical questionnaire must be completed prior to any activity. A medical certificate of fitness for diving less than 12 months old may be required, particularly if "yes" answers appear on the questionnaire.

JLC Diving Corporation and its instructors reserve the right to refuse access to the water to any person whose condition (fatigue, illness, injury, medication, etc.) appears incompatible with safe diving.

Alcohol/substances: zero tolerance for the consumption of alcohol or other impairing substances prior to any activity. The team may refuse the dive without refund in case of reasonable doubt.

Pre-flight interval: the customer remains responsible for maintaining a conservative safety interval (24 h) after the last dives before boarding a plane or climbing to altitude.
6. Age requirements and minors

Minimum age: according to SSI certification and standards (e.g. Junior Open Water from age 10). Certain outings/sites may require a higher age and level.

Minors: participation requires the written consent of a parent/guardian. Minors must be accompanied on site by a designated responsible adult.
7. Levels, experience and site conditions
Some dives may require level/certification, recent experience, a minimum number of dives or the use ofspecific equipment. In the event of current, depth, reduced visibility or special conditions, the team may adapt the itinerary, redirect to another site, or refuse a dive if safety so requires.
8. Insurance

Diving insurance covering emergency medical expenses and evacuation is strongly recommended (compulsory for certain activities, e.g. technical diving).

Incident-related costs (evacuation, hyperbaric chamber, treatment, transport) are not included in our rates and remain the responsibility of the customer.
9. Equipment, breakage and loss
The customer is responsible for the rented equipment. Any breakage, loss or deterioration beyond normal wear and tear may result in a charge corresponding to the cost of repair or replacement at current rates.
10. Behavior and exclusion
Any inappropriate behavior (physical, verbal, harassment, disregard for instructions or the environment) may result inimmediate exclusion from the activity without refund.
11. Environment and local regulations
Customers agree to respect marine life, not to touch/take organisms, to control their buoyancy and to follow local rules (park fees, protected areas, temporary bans, etc.). Fines may apply according to local regulations and will be charged to the offender.
12. Image capture (photo/video)
Unless explicitly opposed in writing prior to the activity, the customer authorizes the reasonable use of his/her image by JLC Diving Corporation for promotional purposes (website, social networks). This authorization may be revoked by simple written request for future publications.
13. Personal data
The data collected (identity, contact details, strictly necessary medical information) is processed to manage reservations, comply with SSI standards and ensure security. It is kept only as long as necessary and may be shared with authorized service providers (e.g. SSI) when required. You have rights of access, rectification and deletion which you may exercise by writing to the center.
14. Prices, taxes and fees
Rates are quoted in the currency indicated at the time of booking and may or may not include local taxes/fees (park fees, municipal charges, fuel, etc.). Any items not included will be specified and invoiced separately if applicable. Prices may vary according to season, availability and market conditions.
15. Liability
JLC Diving Corporation is committed to providing quality services and ensuring the safety of its customers to the greatest extent possible. However, customers participate at their own risk and should be aware of the inherent dangers of diving.
To the fullest extent permitted by applicable law, JLC Diving Corporation shall not be liable for any accident or incident not attributable to its proven fault.
16. Force majeure
Neither party shall be liable for any failure to perform due to an event of force majeure (in particular: severe weather, dangerous seas, critical breakdowns, industrial disputes, administrative decisions, pandemics, etc.). Activities may be cancelled or rescheduled without compensation other than, where applicable, a postponement in accordance with article 2.
17. Applicable law and jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Philippines. Any dispute arising hereunder shall be subject to the exclusive jurisdiction of the Philippine courts.
